This Acceptable Use Policy ("AUP") governs your use of the Kijito service ("the Service") and is part of, and incorporated into, our Terms of Service. Capitalized terms have the meanings given there.
You may not use the Service to store, transmit, generate, or facilitate any of the following:
You are responsible for all content you or your agents store through the Service and for ensuring you have the rights to do so. Because the hosted Service encrypts your content and does not inspect it in the ordinary course, prohibited content may not be detected automatically - this does not make it permitted.
We may, at our discretion and where appropriate, take action including:
Notice & appeal. Where we take enforcement action, we will, at our discretion and where practical and not legally or operationally restricted, notify the affected account. You may appeal by emailing [email protected] within 30 days of the action with relevant information; we will review appeals in good faith but are under no obligation to reinstate access. For severe violations (for example, CSAM, active attacks on the Service, or where required by law) we may act immediately and without prior notice or appeal.
Mandatory reporting. We will report apparent child sexual abuse material (CSAM) to the National Center for Missing & Exploited Children (NCMEC) as required by 18 U.S.C. § 2258A, and will otherwise cooperate with law enforcement and report unlawful activity where required by applicable law.
To report a suspected violation of this AUP - including abuse, a security vulnerability, or infringing/illegal content - contact us with enough detail for us to investigate (the nature of the issue and, where applicable, the affected account or content). We respond to notices of alleged copyright infringement and follow the notice-and-takedown and counter-notice procedures of the Digital Millennium Copyright Act, 17 U.S.C. § 512. If you believe content stored on the Service infringes your copyright, send a written notice containing the elements required by 17 U.S.C. § 512(c)(3) - including your physical or electronic signature; identification of the copyrighted work and of the allegedly infringing material with information reasonably sufficient to locate it; your contact information; a statement of good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act on the copyright owner's behalf - to our designated agent:

If material you submitted was removed or disabled and you believe this was in error or misidentification, you may submit a counter-notice to the same designated agent, meeting the requirements of 17 U.S.C. § 512(g). We may, in appropriate circumstances and at our discretion, terminate the accounts of users who are repeat infringers.
We may update this AUP from time to time; material changes will be communicated as described in the Terms of Service.
